Proceedings at the First Tier Tribunal (FTT) are part and parcel of Block Management and can be a useful and cost-effective resource for resolving a range of Landlord and Tenant disputes.
The FTT are part of the HM Courts and Tribunals Service, with five regionally based tribunal offices (London, Northern, Midlands, Eastern and Southern) based around the country. The FTT (Property Chamber) functions as a specialist and informal forum for the determination of a range of matters affecting Block Management.
Scott Cohen Solicitors has extensive experience in the varied range of applications that can be brought at the FTT to determine the full spectrum of Landlord & Tenant issues. With this experience, Scott Cohen has a thorough understanding of tribunal procedure and the evidence required to successfully progress a tribunal case to conclusion. We can assist with full conduct of matters from the outset to include assessment of the legal position, review and assessment of both the client’s and opponent’s evidence, preparation of pleadings, administration of the case in compliance with directions, and arrangement of representation. We also assist with all steps that may be required in FTT appeals.
Examples of the variety of applications which prove to be useful management tools with which Scott Cohen can assist include:
- Proceedings to determine whether a Service Charge or Administration Charge is payable and/or reasonably incurred.
- Proceedings to determine whether a Breach of Lease covenant has occurred.
- Proceedings to determine whether the costs of Major Works are payable, and in relation to orders for dispensation.
- Proceedings to determine whether a company has successfully acquired the Right to Manage.
- Proceedings to determine the Recovery of Right to Manage costs.
- Proceedings to determine the Service Charges payable to an RTM company at handover of management.
